What is OSS?

The One-Stop-Shop (OSS) is a special VAT scheme for certain cross-border B2C sales inside the European Union. It lets a business declare and pay certain VAT amounts for several EU member states centrally through one member state, instead of running a separate procedure in every country of consumption.

For online sellers, OSS is relevant above all for intra-Community distance sales to private customers. What decides the treatment is which country the goods are delivered to and which VAT rules apply to that particular transaction.

The 10,000 euro threshold

For certain intra-Community distance sales and certain electronic services, an EU-wide turnover threshold of 10,000 euro net applies under certain conditions.

Where the threshold is exceeded under the statutory conditions, the place of taxation for intra-Community distance sales is in principle the member state in which the dispatch or transport to the customer ends.

The 10,000 euro rule does not, however, apply as a blanket rule to every cross-border sale or every business. Place of establishment, type of supply, warehouse structure and further factors can be decisive.

OSS, IOSS and local VAT registration are not the same thing

OSS

OSS can be used for certain cross-border sales to consumers inside the European Union.

IOSS

The Import-One-Stop-Shop (IOSS) concerns certain distance sales of goods imported into the EU from third territories or third countries. It has its own conditions.

Local VAT registration

Not every VAT obligation of an e-commerce business can be handled through OSS. Complex warehouse and goods movements in particular can create additional VAT situations.

OSS should therefore always be seen as part of an online seller's overall VAT and bookkeeping structure.
